Chiquita Canyon Landfill Litigation Update

As set forth in the last status report, damages discovery is now complete and the process of random selection of households as bellwether plaintiffs for trial has begun. A bellwether plaintiff and/or household is chosen as a representative of a certain group and then used as a test case of sorts in an attempt to determine how the entirety of the larger litigation may turn out. In total, twelve bellwether cases were selected. If you and/or your household was selected, we have already reached out to you regarding the same. If you did not hear from us in this regard, you and/or your household was not initially selected. There is no need to be worried if you were and/or were not selected.

Due to various reasons, some of the originally selected bellwether plaintiffs/households will be replaced. Counsel for all plaintiffs continues to work together to facilitate a second random selection of six additional bellwether plaintiffs/households. If you and/or your household is selected, we will reach out to you individually/separately regarding the same.

On June 17, 2024, the court held a status conference wherein the foregoing was discussed. The Court set a trial as to a first group of bellwether plaintiffs on April 29, 2025, at 9:00 a.m. A Final Status Conference will be held on April 8, 2025, at 1:45 p.m. The Court also set a second trial date for the remaining bellwether plaintiffs on May 19, 2025, at 9:00 a.m. Again, if you and/or your household has been selected, we will reach out to you individually/separately with mor information as it becomes available.

A Case Management Conference was set for November 14, 2024, at 1:45 p.m. With the setting of trial dates, we are hopefully that settlement discussions will begin and these cases can reach resolution. Further status updates will be provided as we know more.
