Burney Water District Litigation Update

We’d like to provide an important status update regarding the ongoing legal action titled Kira Bamford, et al. v. Burney Water District, et al., Shasta County Superior Court Case No. 24CV-0204809 (the “Action”).

Background on the Case

The Action was filed on April 17, 2024, alleging various claims related to an E. Coli outbreak in the water supply that affected you.

Key Updates

Since the filing, we have determined that Shasta County, initially named as a defendant, is a separate entity from the Burney Water District and has been dismissed from the Action. The Burney Water District, an independent special district responsible for the public water and sewer system in Burney, remains the primary defendant. They have filed an Answer to our Complaint, which we believe is insufficient. Consequently, our office has filed a Demurrer challenging their response, with a hearing scheduled for September 30, 2024, at 8:30 a.m.

Next Steps in the Legal Process

We have also received discovery requests from Burney Water District, which have been sent to each plaintiff. Discovery is an essential part of litigation, allowing both parties to gather evidence. Our team will assist you in preparing responses, but we will need your cooperation in providing any relevant documents. Important Dates to Note

  • Demurrer Hearing: September 30, 2024, at 8:30 a.m.
  • Settlement Conference: January 13, 2025, at 1:30 p.m.
  • Trial: March 18, 2025, at 8:45 a.m.
